Amendments to the following Regulations:

• 5 - common boundary between an exclusive use area
• 6 - boundaries of the sections and common property
• 10 - substitution of the land under a mortgage bond
• 13 - Insertion 13A: replacement schedule for lost or destroyed schedule of servitudes
• 15 - changes whenever the registration of a sectional plan is cancelled
• 16 - issue and replacement of certificates
• 25 - Insertion 25A: replacement of documentation
• 28 - transfer of exclusive use areas
• 30 - management rules may only be amended once there are 30% owners other than the developer
• 34 - sectional morgage bond forms

Amendment of Annexure 8 - Rules: 

• 31 - Insertion of 2A: budget shall coincide with the financial year of the scheme
• 31 - subrule 4 deleted (special levies)
• 36 - itemised estimate of income and expenditure for approval of AGM
• 39(2) - transmitted by facsimile or electronic mail
• 54(5) - inadverted ommision not invalidate supplemented
• 68(v) - purpose for which an exclusive use area elaborated (a-d)
• 71(4) - chief registrar of deeds shall upon written application and subject to payment of the prescribed fee appoint an arbitrator in writing

No 40% increase of minimum wages for domestic workers in SA

Contrary to the proposals by the CPLO (see below) the Gazetted increase in the minimum wages of domestic workers from 1 December 2011 to 30 November 2012 is less than eight percent (8%). Download Domestic_Worker_amendment_2011.2012

Briefing Paper 271—October 2011. of the Catholic Parliamentary Liaison Office (CPLO). of the Southern African Catholic Bishops' Conference (SACBC), reports on the recent country-wide series of hearings by the Department of Labour to advise the labour minister on determinations of wages.

The existing amendment to Sectoral Determination 7: Domestic Workers, of the Basic Conditions of Employment Act (BCEA), applies up to 30 November 2011. This amendment comprises two (2) minimum Wage Tables for the Domestic Worker Sector:

• Table 1 for those workers who work more than 27 ordinary hours per week
• Table 2 for those workers who work 27 ordinary hours per week or less

Each table differentiate two geographical area categories, namely ‘Category A’ denotes urban areas and ‘Category B’ all other (rural) areas. There are therefore four sets of three each minimum wages specified, namely: hourly, weekly and monthly. A 20% (R1.28 per hour) gap exists between the urban and other categories.

The Sectoral Determination 7: Domestic Workers applies to all domestic workers. This includes independent contractors and domestic workers employed by agencies, but excludes domestic workers who:

• work on farms; or are covered by
• another sectoral determination, or
• a bargaining council agreement.

Various organisations propose a minimum wage of R2500 per month, which represents a sharp rise of almost R1 000 per month (almost 40%) for domestic workers. The CPLO Briefing Paper 271 elaborates on the rationale. Download 35771_bp_271_domestic_workers_wage_determination_hearings_oct_2011
